Why ISPs are adding books to the plan

A price war retains nobody

When a plan is differentiated only by megabits and price, subscribers switch providers at the first better offer. A benefit the whole family uses every week creates a barrier to leaving that a competitor's discount cannot make up for.

The major carriers are already doing this

Vivo, Claro, and TIM — Brazil's largest telecom carriers — have included books, music, and streaming in some of their plans for years. A regional ISP that offers only connectivity is competing with yesterday's product — and without an SVA, ARPU (average ticket) does not move.

The access SVA ends in 2027

Anatel revoked Norma 004/1995 (the rule that classified internet access as an SVA): starting January 1, 2027, internet access may only be offered as SCM. Anyone who relied on classifying access as an SVA needs to migrate to real, content-based SVAs — and books are the most established of them.

Books are the only content with constitutional immunity

The Constitution (art. 150, VI, "d") grants tax immunity to books, and the STF (Brazil's Supreme Court) ruled that format — including audiobooks — does not remove that immunity (RE 330.817 and RE 595.676), a position enshrined in Súmula Vinculante 57, its binding precedent. How the offer is structured and billed determines its tax treatment; streaming, music, and antivirus services have no such basis.

Streaming DRM: content is delivered through URLs that expire per session, with offline downloads encrypted inside the app — never the open file. It is the protection publishers require to release their titles, and the same protection that covers your own content.

Content, not connectivity

Under Brazil's General Telecommunications Law (art. 61), an SVA is an activity that adds new utilities to a telecommunications service without being confused with it. A digital library is exactly that — and it is not affected by the end of the access SVA in 2027.

Tax immunity for digital books

The STF unanimously ruled that the tax immunity granted to books (Constitution, art. 150, VI, "d") extends to ebooks, and that format — including audiobooks — does not remove it (RE 330.817 and RE 595.676), a position enshrined in Súmula Vinculante 57.

Tax reform

With the IBS and CBS — Brazil's new consumption taxes under the tax reform — rate uniformization reduces the advantage of classifying revenue as an SVA. Book immunity, being constitutional, remains — and how the offer is structured is what determines its tax treatment.

SVA stands for "Serviço de Valor Adicionado" (value-added service): a benefit the ISP adds to its internet plan that is not itself a telecommunications service (General Telecommunications Law, art. 61). In the case of books, it is a digital library of ebooks and audiobooks that subscribers access in an app, either included in the plan or sold as an add-on.
